These Terms of Service ("Terms") govern your use of software applications published by Makersoft ("we", "us", or "our"), including MakerZones and WinMode (collectively, the "Software"). By downloading, installing, or using the Software, you agree to be bound by these Terms.

License

Free Tier

We grant you a free, non-exclusive, non-transferable license to use the free version of the Software on any number of personal devices for personal or commercial use. The free tier includes limited features as described on our website.

Pro License

Upon purchase of a Pro license, we grant you a perpetual, non-exclusive, non-transferable, single-user license to use the Pro version of the Software. A single-user license entitles you to activate the Software on the devices you personally use. The license is bound to your person, not to a specific device, but may not be shared with or transferred to other individuals.

Restrictions

You may not:

  • Reverse engineer, decompile, or disassemble the Software
  • Redistribute, sublicense, sell, or lease the Software or your license key
  • Remove or alter any proprietary notices, labels, or marks
  • Use the Software to develop a competing product
  • Circumvent or disable any license validation mechanisms

Payments and Refunds

App Store Purchases

If you purchase the Software through the Apple App Store, your purchase is subject to Apple's terms and conditions. Refund requests for App Store purchases must be submitted through Apple's standard refund process.

Direct Purchases

If you purchase a license directly from us (via our website or Homebrew), we offer a 30-day money-back guarantee. If you are not satisfied with the Software within 30 days of purchase, contact us at [email protected] for a full refund.

Intellectual Property

The Software, including its code, design, graphics, and documentation, is the intellectual property of Makersoft and is protected by copyright and other intellectual property laws. Your license does not grant you ownership of the Software — only the right to use it as described in these Terms.

Disclaimer of Warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MAKERSOFT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SOFTWARE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE.

Accessibility Permissions

MakerZones and WinMode require macOS Accessibility permissions to function. These permissions enable the Software to manage window positions (MakerZones) and remap keyboard input (WinMode). These permissions are used solely for the stated functionality. We do not use these permissions to monitor, record, or transmit any user activity.

Termination

Your license is effective until terminated. We may terminate your license if you breach any of these Terms. Upon termination, you must cease all use of the Software and delete all copies. You may terminate your license at any time by uninstalling the Software.

Updates

Pro licenses include free updates to the Software for as long as the product is actively maintained. We reserve the right to change the scope of features available in the free and Pro tiers.

Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by updating the "Last updated" date at the top of this page. Your continued use of the Software after any changes constitutes your acceptance of the updated Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
